Welcome to Ocean First Marine. These Terms of Service ("Terms") govern your access to and use of our website, products, and services. Please read these Terms carefully before using our website or making a purchase. By accessing or using the website, you agree to comply with and be bound by these Terms.
1. General Information
Ocean First Marine operates the website located at https://oceanfirstmarine.co.uk, where you can browse and purchase marine products, including tenders, RIBs, and accessories.
2. Use of the Website
By using our website, you agree to use it for lawful purposes only. You are not permitted to use our website for any illegal or unauthorised purpose, and you must comply with all applicable laws and regulations when using the site.
You may not copy, modify, or distribute any content from the site without prior written permission from Ocean First Marine.
3. Product Availability
Product availability on our website is subject to stock and demand. We reserve the right to limit the quantity of any item ordered and to refuse or cancel any order at our sole discretion.
While we strive to keep our website accurate, we cannot guarantee that all product descriptions, prices, or availability are accurate at all times. Prices and availability are subject to change without notice.
4. Ordering and Payment
When placing an order, you agree to provide accurate and complete information. You must also be of legal age to enter into a contract and purchase products on our website.
We accept payments through various methods, including credit and debit cards. By providing payment details, you authorize us to charge the full amount for your order. All prices on our website are shown in GBP (£) and include VAT, unless stated otherwise.
5. Shipping and Delivery
Shipping times vary based on product availability and stock. For tenders and accessories, shipping times depend on stock levels. Please refer to our Shipping Policy for more information. For RIBs, as bespoke items, delivery times will vary. It’s important to contact us for an estimated delivery date.
Delivery charges will be calculated during checkout based on your location and the items you order.
6. Returns and Cancellations
Please refer to our Returns Policy for information regarding returns, cancellations, and exchanges. Please note that returns for opened or used tenders are not accepted, and RIBs, due to their bespoke nature, cannot be cancelled after the order is placed.
7. Product Warranties
OCEAN FIRST MARINE Ltd will warranty 3D Tender boats to be free of defects in material and workmanship during the period described hereafter:
DURATION OF COVERAGE
The entire vessel is covered for a period of two (2) years from the date the product is sold.
For commercial use or hire, the entire vessel has a one (1) year warranty.
CONDITIONS THAT MUST BE MET IN ORDER TO OBTAIN WARRANTY COVERAGE
Warranty coverage is available only to customers that purchase from an authorized 3DTender dealer. Routine maintenance outlined in the Owner’s manual must be performed in a timely manner in order to maintain warranty coverage. If the retail customer performs this maintenance, Ocean First Marine Ltd reserves the right to make future warranty coverage contingent on proof of proper maintenance.
POWDER COATING
WHAT Ocean First Marine WILL DO
OCEAN FIRST MARINE Ltd sole exclusive obligation under this warranty is limited to, at our option, repairing a defective part, replacing such part or refunding the purchase price of the 3D Tender product. The repair, replacement of parts, or the performance of service under this warranty does not extend the life of this warranty beyond its original expiration date. OCEAN FIRST MARINE Ltd reserve the right to appoint, at its sole discretion third party repairers to carry out any repairs required under the terms of this warranty.
HOW TO OBTAIN WARRANTY COVERAGE
The customer must provide OCEAN FIRST MARINE Ltd with a reasonable opportunity to repair, and reasonable access to the product for warranty service. Warranty claims shall be made by delivering the product for inspection to a 3D Tender dealer authorized to service the product. If the service provided is not covered by this warranty, the purchaser shall pay for all related labor and material, and any other expenses associated with that service. The purchaser shall not, unless requested by OCEAN FIRST MARINE Ltd ship the product or parts of the product directly to OCEAN FIRST MARINE Ltd. Proof of purchase and ownership must be presented to the dealer at the time warranty service is requested in order to obtain coverage.
WHAT IS NOT COVERED
This limited warranty does not include damage due to misuse abuse, negligence, improper or inadequate storage or transportation, or to any 3DTender boat which is used in a manner contrary to directions or instructions indicated in the 3DTender Owner’s Manual.
The warranty does not cover routine maintenance items, adjustments, normal wear and tear, puncture, discoloration, oxidation, abrasion, mildew or damages due to theft, loss, modification or alteration. Wear parts including but not limited to rubbing strake, keel guard, ropes are not covered by the warranty.
This warranty shall be ineffective if the boat has been operated without proper inflation, or with an outboard motor which exceeds the maximum horsepower rating listed on the serial plate attached to the transom. The Warranty shall become ineffective should the boat rigger or modified in anyway contrary to the advice OCEAN FIRST MARINE Ltd and 3D Tender.
Powder coating condition is not covered by our warranty due to the specific exposed nature of the product, for best long term protection, ensure that your surfaces are rinsed with fresh water after every use and are cleaned immediately of any substances that may stick to the paint surface and cause discoloration or damage. We recommend scratches and dents to be repaired as soon as possible after they occur.
Use of the product for racing or other competitive activity voids the retail warranty. Expenses related to haul-out, launch, towing, storage, transportation, telephone, rental, inconvenience,
slip fees, insurance coverage, loan payments, loss of time, loss of income, or any other type of incidental or consequential damages are not covered by this warranty.
8. Limitation of Liability
To the fullest extent permitted by law, Ocean First Marine shall not be liable for any indirect, special, or consequential damages, or loss of profits arising from the use of our website or products purchased from us. Our liability is limited to the amount paid by you for the specific product or service in question.
9. Privacy and Data Protection
We are committed to protecting your privacy. Your personal information is collected and processed in accordance with our Privacy Policy. By using our website and services, you consent to the collection and use of your data as described in our privacy policy.
10. Intellectual Property
All content on the website, including images, logos, product descriptions, and text, is the property of Ocean First Marine and is protected by intellectual property laws. You may not use any content from our website without our written consent.
